The legal requirements relating to mental health of staff exist in multiple countries. For example, in the UK the Health and Safety Executive state that “Employers have a legal duty to protect workers from stress at work by doing a risk assessment and acting on it. This is the same duty you have to protect people from other health and safety risks.“

Responding to Staff Mental Health
When a staff member discloses that they are experiencing work-related mental health or stress difficulties, you have a duty to respond to them.
This should include factors contributing towards their stress and reasonable adjustments that are being made in the workplace.
To do this, many businesses use the Individual Stress Risk Assessment Tool. This is a Tool that should be completed at direct line-management level whenever possible. It is completed with the staff member prior to any arrangements or signposting being put in place. This Tool then forms part of your organisation’s evidence of meeting legal duties around care for staff.
To support the roll out of the Tool across organisations, we have developed solutions to train managers, HR professionals and others who may be involved in completing the Tool with members of staff.

Mental Health First Responders
Mental Health First Aiders are there to act in an emergency, just the same as First Aiders, they recognise a number of conditions and provide emergency aid. Appointed persons are given life-saving skills training to act in an emergency. Likewise, Mental Health First Responders are trained to act in an emergency – when a colleague is in distress, crisis or overwhelm.
Mental Health First Responders and Mental Health First Aiders are not a control measure to reduce the likelihood of staff mental health difficulties, they do, however form part of your organisation’s response to a mental health emergency and ensure someone is safe and that they are able to access the care they need.
